Topnumbered as M460/B is Despatch No.37 of 23 March 1857
from the Secretary of State, Henry Labouchere. This acknowledges
receipt of the Governor's Despatch of 9 October 1856 (No.158) in
which was forwarded an Act, An Act to enable the Government to
raise certain loans for 1856, passed during the first Session of the
new Parliament and assented to by the Governor in Her Majesty's
name.

Labouchere goes on to set out a principle behind the legislative
enactments of the New South Wales Parliament, and the
relationship of the Colony to Britain
The Acts of the Legislature of New South Wales require no
confirmation by the Crown, having force through the assent of
Her Majesty signified by the Governor, and I think that the
practice which has hitherto prevailed of signifying Her Majesty's
confirmation is inappropriate, and that the inauguration of the
New Legislative bodies affords a fit opportunity for its
discontinuance. It is nevertheless still expedient that the
Governor of the Colony should be informed, on every occasion,
that the operation of the Acts transmitted by him will not be
interfered with by the exercise of Her Majesty's Prerogative of
disallowance.

M13445 comprises a memorandum on the proceedings to be
observed at the opening of Parliament, as approved by the
Governor and the Executive Council on 13 May 1856. " 'A Book
containing an alphabetical List of the names etc of Members
returned to the Assembly will be prepared under the Governor
General's direction, and certified under His Excellency's hand to be
correct according to the Returns received by him; and should be
accompanied by the Writs as returned' ". A subsequent note
suggests that a Roll of the names in parchment should be
sufficient. There is an annotation "Roll prepared & delivered to the
Clerk of the Assembly 21 May 1856".

nomination and summoning of members of the Legislative Council
for the new Parliament. Included are: an extract of the
proceedings of the Executive Council of 6 May 1856 with respect to
the form of summons for members of the Legislative Council; a
draft copy of the writ of summons; an extract of the proceedings
of the Executive Council of 9 May 1856 relating to the nomination
of members of the Legislative Council in which was advised the
names of the persons to be summoned to the Council; a draft
