His Excellency desires me to express how deeply he regrets that
so large a number of highly respected gentlemen should, for
whatever cause, have decided upon withdrawing their services
from the public. Under the circumstances however His
Excellency has no alternative but to accept your resignations
though he do so with extreme regret.
Other letters in this volume include: on 12 June 1861 offering the
Presidency of the Legislative Council to W C Wentworth; on the
same date, offering seats in the Legislative Council to 28 men; on
20 June 1861 offering seats to a further 3 persons; and, on
24 June 1861 thanking Alexander Berry for his 32 years service on
the Legislative Council.

1859 Despatches

Included in box [4/1349] is Duplicate Despatch No.32 of
21 October 1859 from the Secretary of State. In this Despatch the
Duke of Newcastle acknowledges the Governor's Despatch of
4 December 1858, No.189, in relation to the proposed consultation
with the Legislature about the separation from New South Wales
and transfer to South Australia of a portion of the Territory lying
between the western boundary of South Australia and the eastern
frontier line of Western Australia.
Despatch No.32
Noting the long delay in the decision which "is a question of
practical importance to South Australia", Newcastle writes that he
would prefer to take no definite steps without a previous
communication from the Governor although legal opinion, a copy
of which is included, is that the Crown has full power to effect the
proposed change.
1861 Despatches
Included in box [4/1351] is Secretary of State Duplicate Despatch
No.52. Referring to the Governor's despatch of 23 June 1860
(No.70), the Duke of Newcastle was transmitting a copy of a
recently passed Act annexing a portion of New South Wales to
South Australia, 24 & 25 Vic c.44, which has received Her
Majesty's assent.

Newcastle brings the Governor's attention in particular to the
provision made in the Act to enable "the Governors of any two
contiguous Australian Colonies with the approval of The Queen to
alter the boundaries from time to time of any of the Australian
Colonies on the main land as may hereafter be deemed
expedient".
