1853 Legislative Council — LC 53/21

LC 53/21 is an Address to the Governor from the Legislative
Council, dated 29 July 1853, requesting that he
will be pleased to recommend to this House the following
Schedule to be annexed to a Bill "to confer a Constitution on
NSW, and to grant a Civil List to Her Majesty" in lieu of the
Schedule A appended to 13 and 14 Victoria, cap 59 and as an
equivalent for the surrender of all Territorial, Casual and other
Revenues of the Crown from whatever source arising within this
Colony.
Included are: copies of 17 Victoria, 1853 A Bill (As amended in
Committee.) To confer a Constitution on New South Wales. and to
grant a Civil List to Her Majesty; Abstract of the Sums required to
defray the Expenses of the Colonial Government of New South
Wales, for the Year 1854, shewing also the Amount Voted for the
previous Year, 1853; extracts of minutes of proceedings of the
Executive Council, Minutes No.52/37 and 53/23 of 27 September
1852 and 16 May 1853 respectively, advising with reference to an
Address from the Legislative Council respecting a permanent Civil
List of 17 September 1852; and correspondence from the Auditor
General and the Chief Justice and Judges of the Supreme Court
concerning the Civil List.
Also included is an earlier Address, LC 52/119, dated
17 September 1852, which is a similar request to the Governor but
with a different schedule.
The Governor's response to LC 53/21 was Message No.26 of
5 August 1853. The Governor's minute on the Address is "Let a
Message be prepared recommending the appropriation proposed
by the Council".
1853 Legislative Council — LC 53/48
LC 53/48 is an Address of the Legislative Council, dated
21 December 1853, embodying Resolutions of the Council on the
Act for conferring a Constitution, A Bill to confer a Constitution on
New South Wales and to grant a Civil List to Her Majesty, together
with a Draft Act of Parliament to enable Her Majesty to assent to
the measure. A copy of the draft Bill was transmitted to the Law
Officers, the Attorney General and the Solicitor General, who
advised, in their letter of 29 December 1853 (CSIL 53/11872),
that "this Bill must be reserved for the signification of Her
Majesty's pleasure thereon" and that they did not think that "any
amendments are necessary to give legal effect to the intention of
The Legislative Council and to render the Bill in other respects
unobjectionable".

relating to the Constitution Bill highlighted; and printed Weekly
Reports of Divisions in Committee of the Whole Council extracted
