Legislative Council elections, 1933-45 (File 42/5037)
Following receipt of the Royal assent (on 24 September 1933) to
the Constitution Amendment (Legislative Council Elections) Act,
1933, arrangements were put in train for elections for the
reconstituted Legislative Council. In the Government Gazette of
16 April 1934, the Governor proclaimed 23 April 1934 as the day
on and from which the Legislative Council of the State of New
South Wales would be reconstituted (referred to in the
Constitution Amendment (Legislative Council) Act, 1932, as "the
appointed day").

In addition to papers about the first elections in 1933 for the
reconstituted Legislative Council, this file mainly comprises papers
relating to elections for the Council caused by casual vacancies.
[9/3909.2] contains papers dating from 1936 to 1945 while papers
dating from 1933 to 1942 are in [9/3910.1].
[9/3910.1] contains papers relating to the election of the 60
Members who were to be elected for the first constitution of the
Legislative Council by four separate elections at each of which 15
Members were to be elected. The elections were held between
2 November and 14 December 1933, with the return of writ due on
17 January 1934.
The papers in [9/3909.2], which commence with the first triennial
election of the Legislative Council on 8 December 1936, relate to
casual vacancies in the Council caused by the death or resignation
of Members, or in the case of Theodore Charles Trautwein in 1940
because of his conviction for an "infamous crime" within the
meaning of Section 19 of the Constitution Act.
Included are: draft and printed writs of election; copies of public
notices issued by the Clerk of the Parliaments as Returning Officer
for the Legislative Council elections; minutes to and from Governor
and Premier concerning the filling of vacancies; public notices
declaring the results of elections; copies of certificates from the
Returning Officer respecting the election of Members; extracts
from Hansard; copies of Regulations under the Constitution
(Legislative Council Elections) Act; and newspapers clippings about
Members who had died.
[9/3909.2] also includes, for the first triennial election in 1936:
draft public notice, an announcement as to ballot and candidates,
dated 25 November 1936; result sheet for the election of
Members; the certificate of those candidates declared to be duly
elected on 10 December 1936; and, a copy of the certificate and
result sheet.
Also included in [9/3910.1] are: copies of the Constitution Further
Amendment (Referendum) Act, 1930, the Constitution Amendment
(Legislative Council) Act, 1932, the Constitution Further
Amendment (Referendum) Act, 1932, and the Constitution
Amendment (Legislative Council Elections) Act, 1933; the
Returning Officer's certificate setting out the names of the
candidates declared to be elected at each of the four elections of
Members to the Legislative Council, and result sheets relating to
these elections, ordered to be printed 13 February 1934.
