When the New South Wales Constitution Act, 1855, was enacted, Garden
Island, in Port Jackson, was part of the waste lands of the Crown, the
entire management and control of which were vested by s.2 of that Act in
the legislature of the Colony. By notices published in 1865 and 1866,
pursuant to the Crown Lands Alienation Act, 1861 (N.S.W.), the island
was dedicated as a naval depot. It continued to be so used by the
Imperial Naval Authorities until 1913, but since that date it had been
occupied by the Commonwealth naval authorities for the use of the naval
forces which it provided and maintained. An Imperial Order in Council
made in 1899 under the Colonial Fortifications Act, 1877, recited an
agreement by which the Government of New South Wales were to erect
buildings and carry out works (partly on Garden Island), and the Imperial
Government agreed that when the buildings and works were completed
and the sites "conveyed, granted, or dedicated in perpetuity for the use of
Her Majesty's navy in the same way as Garden Island had been" the
Imperial Government would surrender certain lands which were not within
s.2 of the Act of 1855; the Order then, in consideration of the agreement,
vested the lands in the Government of New South Wales. In 1923 the
Minister administering the Crown Lands Consolidation Act, 1913 (N.S.W.)
acting under s.25 of that Act, revoked the dedication of Garden Island ...

there are some earlier papers, including 1844 grants of Pinchgut
Island, part of Goat Island and part of Bent Street to the Principal
Officers of Ordnance in Great Britain.

This file contains papers relating to the handing over of Garden
Island to the Commonwealth as well as those relating to the
transfer of Admiralty and Ordnance lands from the Imperial
authorities to the New South Wales Colonial Government and
properties to be transferred to the Imperial Government in
exchange.
Includes papers relating to: the transfer of Ordnance lands from
the Imperial authorities to the Colonial Government in the 1890s;
transfer to the Commonwealth Government of the properties used
by the Imperial Government for naval purposes in Sydney; the
proposed dedication of Goat Island as a public recreation reserve;
maintenance of the Naval Station at Sydney, ie whether costs
should be met by the State or the Commonwealth (Spectacle
Island, the Naval Ordnance Stores, particularly mentioned);
transfer of Spectacle Island from the State to the Commonwealth
and as to cost of maintenance, alterations, etc; works required for
upkeep of the Naval Magazine established at Spectacle Island and
the Victualling Stores at Darling Island; position of Sydney as a
naval station 1910; proposal in 1911 for having the land at
Kirribilli Point opened up as a public park, in the event of the
Admiral vacating these premises; 1912-13 Government House
Appeal Case (Garden Island and Ordnance Lands); actions in the
High Court and Privy Council in the 1920s in respect of Garden
Island and Admiralty House; suggestion that the State should
